Terms and Conditions

1. General Provisions
These Terms and Conditions ("Terms") govern your use of StickItLab, operated by deToon ("we", "us", "our", "the Company"). By accessing or using our website and services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of the service after any changes indicates your acceptance of the new Terms.
2. Definitions
- Service: The custom sticker printing service provided through StickItLab.
- User: Any individual or entity that registers for and uses our service.
- Content: Any images, designs, or other materials uploaded by the User.
- Products: Custom printed stickers produced from User Content.
3. Account Registration
3.1 Eligibility
You must be at least 16 years of age to create an account. By registering, you represent that you meet this age requirement and have the legal capacity to enter into a binding agreement.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3.3 Account Information
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
4. Use of Service
4.1 Acceptable Use
You agree to use our service only for lawful purposes. You may upload content that includes adult or NSFW material, provided it does not violate applicable laws.
4.2 Prohibited Content
You may not upload content that:
- Infringes on intellectual property rights of third parties
- Contains illegal material, including but not limited to child exploitation material
- Promotes violence, terrorism, or hatred
- Contains malware, viruses, or other harmful code
- Violates any applicable local, national, or international law
4.3 Intellectual Property
You retain ownership of any content you upload. By uploading content, you grant us a limited license to reproduce and print your designs solely for the purpose of fulfilling your order. You represent and warrant that you have the necessary rights to use and authorize us to print the uploaded content.
5. Orders and Payment
5.1 Order Placement
By placing an order, you make an offer to purchase products. We reserve the right to refuse or cancel any order at our discretion, including but not limited to orders containing prohibited content.
5.2 Pricing
All prices are displayed in Euros (EUR) and include VAT where applicable. Prices are subject to change without notice. The price at the time of order placement will be honored.
5.3 Payment
Payment must be completed at the time of order placement. We accept major credit cards and other payment methods as displayed at checkout. All transactions are processed securely through our payment providers.
6. Production and Delivery
6.1 Processing Time
Orders are typically processed within 24 hours on business days. Orders placed after 15:00 CET or on weekends/holidays will be processed the next business day.
6.2 Shipping
We ship from the Netherlands. Shipping times vary by destination. We are not responsible for delays caused by shipping carriers, customs, or other factors beyond our control.
6.3 Risk of Loss
Risk of loss passes to you upon delivery of the products to the carrier.
7. Returns, Refunds and Cancellations
7.1 Custom Products
As our products are custom-made to your specifications, we cannot accept returns or provide refunds for change of mind or incorrect uploads. Please review your order carefully before submitting.
7.2 Defective Products
If you receive defective products (printing errors, damaged items, or items that do not match your specifications), please contact us within 14 days of receipt. We will provide a replacement or refund at our discretion upon verification of the defect.
7.3 Cancellation
You may cancel your order within 1 hour of placement if production has not yet begun. Contact us immediately if you wish to cancel. Once production has started, cancellation is not possible.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- Our total liability for any claim arising from or related to our service shall not exceed the amount paid by you for the relevant order.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
- We are not liable for any loss of profits, data, business opportunities, or goodwill.
9. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.
10. Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. We process your data in compliance with the General Data Protection Regulation (GDPR) and the Dutch Algemene Verordening Gegevensbescherming (AVG).
11. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
